Visto Files Patent Infringement Lawsuits against Infowave and Seven


Complaints Seek Injunctions, Damages

(Redwood Shores, CALIF., September 23, 2003) – Visto Corporation (www.visto.com), the leading provider of personal and corporate mobile access solutions that are easy to install, administer and use, today announced that it has filed complaints alleging patent infringement against Infowave Software, Inc. (IW on the Toronto Stock Exchange) and Seven Networks, Inc. of Redwood City, CA. The complaints, filed in the U.S. District Court for the Eastern District of Texas, will also ask for preliminary and permanent injunctions prohibiting Infowave and Seven from continuing to misappropriate Visto’s intellectual property. Visto will also be seeking monetary damages as compensation for Infowave’s and Seven’s illegal actions.

“Visto has spent seven years and nearly $100 million dollars researching, developing and patenting technologies that are key to the secure synchronization of data within networks, and which are vital to Visto’s industry-leading solutions for data mobility. We believe that Infowave and Seven have built significant portions of their businesses on unauthorized use of our patents, with absolutely no patents of their own,” said Brian Bogosian, chairman, president and CEO. “Visto has the resources and the will to see that all illegal uses of our technologies are stopped,” he said.

Specifically, Visto is alleging that Infowave is violating Visto patent no. 5,961,590, which relates to the system and method for synchronizing email. Visto’s claims against Seven reference two Visto patents, nos. 6,085,192 and 6,023,708, which describe systems and methods for securely synchronizing multiple copies of a workspace element in a network, and the use of a global translator to synchronize workspace elements across a network.
