
Create an Alert to Track Newly Filed Applications in the U. S. Trademark Office That Are Similar to My Marks?
TOPIC: It is important to watch for newly filed trademark applications for marks that may
conflict with or will be likely to cause confusion with your mark. If such a mark is found,
the owner of the first mark can take action such as sending a "cease and desist" letter
immediately or watching a potentially confusing mark until it publishes and the owner of
the first mark is able to file an opposition proceeding with the Trademark Trial and
Appeal Board (TTAB) against registration of the mark.
In this example you are you are watching several trademarks to make sure others are not similar to them. You will search the TRADEMARKSCAN—U.S. Federal (File 226) file, which covers all active, registered trademarks and service marks and applications for registrations filed for marks used or intended to be used on every type of product or service that is marketed commercially in the U.S.

HOW TO...

1. BEGIN in TRADEMARKSCAN—U.S. Federal (File 226).
2. Search for similar marks using the rotated index (TR=) and the name of the marks.
3. Combine sets using the rank (:) symbol to OR together the sets. |

4. TYPE a few records to make sure the search is accurate before setting up the Alert.

5. Use AP=9999 to restrict the search to new applications added to the latest update.
6. Start the Alert set-up process by typing SAVE ALERT. |

7. Type a name of up to 30 characters for the Alert .
8. When using AP=9999 choose the Alert update frequency schedule.
Note: There are no duplicate records in this file.
9. Review the Alert settings for accuracy.
10. Enter the PRINT command (e.g., PR S#/format/# of records).
10. Click the SAVE button to save the Alert. |
