Create an Alert to Track the Progress of a Specific U.S. Trademark Application?

TOPIC: In the U.S., once the trademark examiner finds the mark eligible for registration, the
mark is published in the USPTO Official Gazette, and parties who feel they have grounds to
object to registration of the mark may file an Opposition proceeding with the Trademark Trial and Appeal Board (TTAB) within a limited time period. While there are provisions for attempting to cancel a mark after registration, the registration provides certain presumptions of validity so the case is harder to make than an Opposition.

In this example you are setting up an Alert that will give notice when a proposed mark publishes in the USPTO Official Gazette. You will search the TRADEMARKSCAN— U.S. Federal (File 226) file, which covers all active, registered trademarks and service marks and applications for registrations filed for marks used or intended to be used on every type of product or service that is marketed commercially in the U.S.

Click S1 > Tasks > Save Alert
Follow the Alert menu


HOW TO...


1. BEGIN in TRADEMARKSCAN—U.S. Federal (File 226).

2. SELECT the serial number of the application (SN=).

3. Start the Alert set-up process by clicking S1 > Tasks > Save Alert.

4. Enter a name for the Alert of up to 30 characters.

5. Set the Alert to run when the database is updated since time is of the essence.

Note: There are no duplicate records in this database.

6. Check the Alert settings to make sure they are what you want.

 

 

 

 

 

7. Enter a PRINT command (e.g., PR S#/Format/Number of records)

8. SAVE the Alert.
