Find the Expiration Date of a Main Product Patent Protecting a Specific Drug?

TOPIC: There are several patent databases that can be used to find patent expiration information. For U.S. patent databases like CLAIMS®/U.S. Patents (File 340), you can search with the patent number. For the most up-to-date U.S. patent legal status, use CLAIMS®/U.S. Legal Status (File 123). For DIOGENES® (File 158), search using the Source – the New Drug List and the drug name. Other databases INPADOC (File 345) and IMS Patent Focus (File 447) show international legal status.

In this example, using the patent number in the CLAIMS databases (Files 340 and 123), you want to find the expiration date for the patent for Mivacron.

1. BEGIN File 340, CLAIMS/U.S. Patents, to view U.S. patents and published applications. 2. SELECT the patent number prefix (PN=), country code and patent number. 3. TYPE the patent record using Format 9 for the complete record.
View the record legal status. Reassignment data Extension of the patent
4. To view the most current legal status in more detail, BEGIN File 123, CLAIMS/U.S. Legal Status. 5. SELECT the same patent number and TYPE the record in Format 9. All legal status changes are listed, along with details of the changes.
The length of the extension is given, along with the trade name and date of expiration. In this example, the patent has also been reassigned. All reassignment data is given.
